The medical Cannabis Industry
Understanding Medical Cannabis in South Africa
South Africa’s medical cannabis industry is regulated by national legislation and the South African Health Products Regulatory Authority. While private cultivation and possession are permitted under certain circumstances, the commercial sale of cannabis to the public remains prohibited unless it takes place within the applicable medical regulatory framework.
Patients cannot simply purchase medical cannabis from a retail store. Access is generally provided through a registered healthcare professional who determines whether medical cannabis is appropriate for the patient’s condition. Where required, a Section 21 authorisation allows access to certain unregistered cannabis medicines under the provisions of the Medicines and Related Substances Act
What is a Section 21 Authorisation?
Section 21 of the Medicines and Related Substances Act provides a mechanism through which SAHPRA may authorise access to an unregistered medicine where appropriate.
Applications must contain information supporting the medical need for the medicine and its proposed use. SAHPRA considers factors including the patient’s clinical circumstances, the seriousness of the condition, available treatment alternatives and supporting information relating to the requested medicine.
Importantly, Section 21 authorisation does not mean that the medicine has been registered by SAHPRA. SAHPRA specifically states that Section 21 medicines have not undergone the same benefit-risk assessment applied during normal medicine registration.
From Cultivation to the Patient
Medicinal cannabis operates within a controlled pharmaceutical supply chain.
Cultivation of cannabis for medicinal purposes is regulated by SAHPRA, with applicable licensing and quality requirements governing activities such as cultivation and manufacturing. SAHPRA’s framework is intended to support appropriate standards for the production, distribution and supply of medicines and scheduled substances.
Depending on the activities being performed, businesses operating within the medical cannabis supply chain may therefore require appropriate licences, quality systems and regulatory authorisations.
A compliant supply chain should maintain traceability and appropriate documentation from cultivation and manufacturing through distribution and eventual dispensing or supply to the authorised patient.
